BOSTON (Legal Newsline) — A Boston woman alleges she suffered severe burns at a Dunkin' Donuts drive-thru when a lid came off her coffee, which spilled on her legs.
Yolandita Ocasio filed a complaint May 17 in Suffolk County Superior Court against Springfield Donuts, Inc., doing business as Dunkin' Donuts, and Liberty Mutual Insurance, alleging negligence.
According to her complaint, Ocasio went through the Dunkin' Donuts drive-thru on Armory Street in Boston on Oct. 3, 2021. She claims she ordered two hot coffees and two iced coffees, which the Dunkin' Donuts employee put in a cardboard tray.
Ocasio alleges that when the employee handed her the tray, one of the hot coffees fell out, with the lid popping off and caused "scalding" coffee to spill on her legs. She further alleges she suffered severe burns to her legs and has permanent scarring.
Ocasio claims Dunkin' failed to serve the coffee at an appropriate temperature, failed to properly place the lid on the coffees and failed to place them properly in the tray, which could not hold the weight of the coffees. She alleges Dunkin's insurance company, Liberty Mutual, denied her claim stating she failed to "take the tray with two hands." She also alleges surveillance video shows the coffee tumbled out of the tray and that the employee stated on the incident report that the coffee lid was not on all the way.
Ocasio seeks monetary relief, interest and all other just relief. She is represented by Attorney Linda Abrahams in Natick.
