The Liberty Justice Center has initiated legal proceedings against the U.S. Consumer Product Safety Commission (CPSC), representing Nested Bean, Inc. This lawsuit addresses allegations of the CPSC's excessive regulatory actions, particularly attributed to Commissioner Trumka, which reportedly have harmed Nested Bean’s operations and reputation.
Nested Bean, established in 2011 by Manasi Gangan, claims that Commissioner Trumka made damaging, unfounded claims about the safety of its infant sleep products. Despite attempts to resolve the matter through correspondence, the CPSC maintained statements that Nested Bean contends are inaccurate, resulting in significant business repercussions.
In 2023, Commissioner Trumka's attempt to initiate mandatory standards for these products was rejected by the commission due to insufficient scientific evidence. Yet, he later circulated letters urging retailers to discontinue selling Nested Bean's products over safety concerns, actions that went unsupported by scientific data.
Nested Bean, though demanding retraction of these statements, met with refusals from Trumka, who categorized them as personal views, despite their official presentation. As a result, Trumka is now under Congressional scrutiny for acting beyond his regulatory scope.
The Liberty Justice Center further claims that there has been an abdication of CPSC protocol and seeks to have statements about product safety clarified. The CPSC has not issued a recall nor established standards for the criticized products, they assert.
Loren Seehase from the Liberty Justice Center pronounced, “The CPSC has a statutory obligation to make sure the statements it makes to the public are not inaccurate or misleading regardless of whether the identity of the manufacturer is easily identifiable. But Commissioner Trumka disregarded the law and the decisions of the entire Commission, and sent letters to retailers and the public claiming multiple infant deaths were attributable to Nested Bean when that is completely false.”
The legal case, Nested Bean, Inc. v. U.S. Consumer Product Safety Commission, was filed in the District Court of Delaware on March 28, 2025.
