Vermont Supreme Court advisory committee to discuss electronic filing rules

The Vermont Supreme Court's Advisory Committee on Rules for Electronic Filing will convene on September 20, 2024, at 9:00 am. The agenda includes several key items.

The meeting will begin with the approval of minutes from the May 2024 meeting and a welcome to new committee member Laura Gans.

Business items include discussions on promulgated amendments to V.R.E.F. 2(c) and 8(c), which were issued on June 1, 2024, and will take effect on January 1, 2025. Additionally, the Vermont Digital Evidence Portal (VDEP) has been operational in all divisions of the superior court since June 3, 2024.

Attorney Levine will provide an update from the AI subcommittee on rules. Attorney Brown previously recommended that forms used by self-represented litigants include an option for service by e-filing and email. Teri Corsones is expected to report on this matter.

An update on the appeals process for rejected filings under V.R.E.F. 5(d)(7), which became effective January 8, 2024, will also be provided by Teri Corsones.

Lastly, J. Toor has requested that rules be amended to reinstate the requirement of a certificate of service for every filing. She noted difficulties in determining service status in cases involving both lawyers and self-represented litigants without such certificates.

The next meeting date is yet to be determined.
