A new state law aimed at protecting Floridians from moving scams is now in effect. The legislation mandates that movers register with the state, provide clear contracts, and avoid misleading advertising. Additionally, penalties have been increased for movers who refuse a lawful order to return private possessions to clients. To highlight these changes and inform residents about moving scams, Attorney General Ashley Moody is updating the "Scams at a Glance: On the Move" resource.
Attorney General Ashley Moody stated, “Moving is stressful, and deceitful movers can compound the stress involved with relocating. Starting today in Florida, there is a new law in place to better protect consumers trying to relocate. To highlight these changes and equip Floridians with the tools they need to spot and avoid moving scams, we are updating our Scams at a Glance: On the Move resource.”
In an effort to protect those moving to or within Florida, Attorney General Moody’s Consumer Protection Team has taken action against more than 18 movers and brokers accused of scamming consumers. Since taking office in January 2019, consumer protection investigations led by Moody have resulted in approximately $27 million in fines and restitution against moving firms.
The new provisions of Chapter 507 of the Florida Statutes introduce several consumer protection measures for household moving services within Florida:
- **Mandatory Registration:** All movers and brokers must register with the Florida Department of Agriculture and Consumer Services.
- **Enhanced Transparency:** Movers are required to provide detailed estimates and contracts outlining all potential costs, dates, and terms.
- **Advertising Integrity:** Strict guidelines prevent false claims in advertisements and require disclosure of registration status.
- **Clarified Punishments:** Refusal by a mover or associated personnel to comply with an order from law enforcement can result in third-degree felony charges and fines up to $50,000.
Following the enactment of this law, Attorney General Moody is updating "Scams at a Glance: On the Move" to help residents avoid common pitfalls during relocation.
Tips from "Scams at a Glance: On the Move" include:
- Verify that interstate movers are licensed with the Federal Motor Carrier Safety Administration (FMCSA).
- Check if intrastate movers are licensed with the Florida Department of Agriculture and Consumer Services.
- Read all contract documents thoroughly before signing.
- Consider personally transporting important items needed immediately upon arrival.
