SAN FRANCISCO (Legal Newsline) — A California woman claims Dior Forever Foundations with SPF are fraudulently labeled as 24-hour protection.
Alexis Slaten, an individual, on behalf of herself the general public and those similarly situated, filed a complaint Jan. 27 in the U.S. District Court for the Northern District of California against Christian Dior Inc., alleging false advertising, fraud and other claims.
Slaten, according to her class action, has purchased Dior Forever Foundation from Macy's in San Daly City during the past four years. She claims the makeup is "unlawfully labeled" as "24 HR Foundation" and "24HR Wear...Foundation with Sunscreen."
Slaten alleges the products do not and can't provide 24 hours of SPF protection as the labels falsely and deceptively claim. She claims the representation that the defendant's products, which include Dior Forever Foundations and Dior Forever Skin Glow Foundation, will provide SPF protection for longer than two hours is misleading.
Slaten further claims the product boxes labeled "24H Foundation" lead a reasonable consumer to believe the products will provide all its benefits, including SPF protection, for the advertised 24 hours.
Slaten and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Seth Safier, Marie McCrary and Hayley Reynolds of Gutride Safier LLP in San Francisco.
