Couple allege Dollar General charges higher price at register than advertised on shelves

WHITE PLAINS, N.Y. (Legal Newsline) — A New York couple claim Dollar General is charging higher prices at the register for merchandise than the prices advertised on the shelves. 

Joseph Wolf and Carmen Wolf, on behalf of those similarly situated, filed a complaint Jan. 23 in the U.S. District Court for the Southern District of New York against Dollar General Corporation, Dolgen New York LLC doing business as Dolgen, Dolgencorp of Texas Inc., individually, jointly, severally or in the alternative alleging violation of New York General Business Law and other claims. 

The plaintiffs claim in their class action that they regularly shop at a Dollar General in White Lake, New York. They claim that while shopping at the store in 2022, they noticed that they were being charged higher prices at the checkout than the prices of the merchandise advertised on the shelves. 

Specifically, the plaintiffs claim they were charged $4.25 for milk that was advertised as $4.15 and charged three for $2.25 for yogurt that was advertised on the shelf as three for $2.00. The plaintiffs allege that Dollar General's practice of charging higher prices at the register for merchandise than advertised on the unit price labels on the shelves violates New York law. 

They also allege the defendants "know full well" they are overcharging consumers so they can "reap outrageous profits." 

The plaintiffs and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Javier Merino of The Dann Law Firm PC in North Brunswick, New Jersey.
