Lawsuit against Arby's: Where's the wagyu beef?

NEW YORK (Legal Newsline) - Arby's is being sued because it uses the word "wagyu" to promote some of its burgers.

Plaintiff Jason Jaghori filed a class action lawsuit July 7 in New York federal court over the Bacon Ranch Wagyu Steakhouse Burger and the Deluxe Wagyu Steakhouse Burger. Wagyu is a breed of cattle from Japan.

The patties contain 48% regular angus beef, the suit says.

"Plaintiff and Class members purchased the Products and paid a premium price based on Defendants’ advertising the Products as 'wagyu,' which is seen as a premium type of beef due to its unique taste and marbling of fat," the suit says. 

"Had Plaintiff and Class members been aware of the truth about the Products, they would not have purchased them, or would have paid significantly less for them."
