Mexican citizen indicted for illegal reentry and document fraud in Pennsylvania

Herminio Lopez-Gervacio, a 50-year-old Mexican citizen residing in Loganton, Pennsylvania, has been indicted by a federal grand jury. The United States Attorney’s Office for the Middle District of Pennsylvania announced the indictment on April 23, 2025. The charges against Lopez-Gervacio include illegal reentry into the United States, possession of a fraudulent document, and aggravated identity theft.

Acting United States Attorney John C. Gurganus reported that the indictment alleges Lopez-Gervacio was found in Clinton County on or about February 17, 2025, after being previously deported. It is claimed that he was deported from the United States on May 5, 2011, through El Paso, Texas, and subsequently reentered without legal permission.

The investigation was conducted by the United States Immigration and Customs Enforcement and Removal Operations. The prosecution is led by Assistant U.S. Attorney Robin Zenzinger.

This case is part of Operation Take Back America, a national initiative by the Department of Justice targeting illegal immigration, transnational criminal organizations, and violent crime. It combines efforts from the Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood.

Under federal law, aggravated identity theft carries a mandatory minimum of two years in prison and a potential fine. Sentencing includes consideration of federal statutes and guidelines, with a possibility of supervised release post-imprisonment.

It is important to note that indictments are allegations, and those charged are presumed innocent unless proven guilty in court.
