Attorney General Dave Sunday has initiated legal action against Philadelphia home improvement contractor Michael Davis and his company, 1st Choice Roofing, Inc. The lawsuit accuses the contractor of poor workmanship and failing to refund dissatisfied customers.
This legal move arises from numerous complaints submitted to the Office of Attorney General’s Bureau of Consumer Protection. The bureau asserts that 1st Choice Roofing overlooked the Home Improvement Consumer Protection Act, with contracts missing crucial components such as a Notice of Cancellation, terms of work duration, and insurance information.
The attorney general has encouraged additional affected consumers to come forward with complaints. "Home upgrades improve quality of life and instill a sense of pride in homeowners. In these cases, consumers dealt with subpar work and were ignored when they requested refunds," Attorney General Sunday noted. "My Bureau of Consumer Protection is dedicated to protecting the rights of Pennsylvanians who are harmed by bad business practices.”
Reports from consumers cited insufficient or unfinished work, alongside unfulfilled refund demands. In one instance, a consumer paid a $500 deposit for chimney work that was never started, and refund requests were disregarded.
The lawsuit seeks court orders for Michael Davis and 1st Choice Roofing to reimburse affected customers, cover legal penalties, and pay costs related to the investigation and litigation. It also calls for the court to declare the contractor in violation of the Home Improvement Consumer Protection Act, compelling compliance.
Senior Deputy Attorney General James S. Wise filed the lawsuit in the Philadelphia County Court of Common Pleas, with the case awaiting the court's acceptance. Consumers impacted by dealings with 1st Choice Roofing or Michael Davis are advised to file complaints with the Attorney General's Office online, by phone, or via email.
