Hialeah tax preparer sentenced to prison for aiding false tax return preparation

Today, Beatriz Toledo, the owner of a tax preparation business in South Florida, was sentenced to nearly five years in federal prison for her role in preparing false tax returns. Following her release, she will serve one year under supervised release and must pay over $20 million in restitution to the IRS.

Toledo, 61, owned Immigration and Tax Service Group LLC. From 2017 to 2021, she knowingly prepared fraudulent tax returns that included incorrect claims for the Residential Energy Credit, false deductions for state and local sales taxes, and fictitious business expenses. These actions reduced her clients' taxable income and increased their refunds.

The scheme involved approximately 7,800 tax returns with fraudulent residential energy credits claims. This resulted in an estimated $20 million underpayment of federal taxes by Toledo's clients. Her company received around $7.1 million directly from clients' refund checks as fees.

In 2010, a permanent injunction barred Toledo from preparing false tax returns following a civil case where the United States sought to prevent such conduct. Despite this prohibition entered on July 26, 2020, Toledo continued her activities until her indictment in 2024.

The announcement was made by U.S. Attorney Hayden P. O’Byrne for the Southern District of Florida and Special Agent in Charge Emmanuel Gomez of the IRS Criminal Investigation (IRS-CI), Miami Field Office.

The IRS-CI Miami Field Office conducted the investigation with Assistant U.S. Attorney Will J. Rosenzweig prosecuting the case.
