Illegal immigrant receives prison sentence after DUI arrest

Kenny Fernando Castillo, 29, has been sentenced to 12 months in prison following his arrest for drunken driving by the Foley Police Department on December 14, 2024. Court documents revealed that upon his arrest, authorities suspected Castillo was not a U.S. citizen and contacted Immigration and Customs Enforcement (ICE). ICE confirmed that Castillo had been removed from the United States in 2018 and had a prior DUI conviction in 2017.

Judge Moorer sentenced Castillo to a year of incarceration followed by a one-year term of supervised release. Upon completing his prison sentence, Castillo will be referred to immigration officials for deportation proceedings. Additionally, he was ordered to pay $100 in special assessments.

The announcement was made by U.S. Attorney Sean P. Costello of the Southern District of Alabama. The case was investigated by the Department of Homeland Security, Homeland Security Investigations, Immigrations and Customs Enforcement, and Foley Police Department.

Assistant U.S. Attorney Kacey Chappelear prosecuted the case for the United States. This prosecution is part of Operation Take Back America, an initiative aimed at addressing illegal immigration and combating cartels and transnational criminal organizations while protecting communities from violent crime.
