A Richmond man has been sentenced to nine years and two months in prison for being a felon in possession of a firearm. Herman Leroy Mallory Jr., 40, was arrested on April 19, 2024, by agents with the FBI Capital Area Human Trafficking Task Force on outstanding warrants from Louisa County.
Court documents reveal that when Mallory was removed from his vehicle, agents observed a handgun on top of the speaker deck and another partially covered with a t-shirt on the floorboard. A search of the vehicle led to the discovery of two rifles, a 50-round drum magazine, additional ammunition and firearm magazines, along with narcotics including cocaine, methamphetamine, fentanyl, and heroin.
Mallory has prior convictions for felony larceny, grand larceny, conspiracy to possess with intent to distribute cocaine base, and conspiracy to commit breaking and entering. As a convicted felon, he is prohibited from possessing firearms or ammunition.
On April 30, 2024, a victim reported to police that a rifle had been stolen from his home approximately three weeks earlier when Mallory had been a guest. The victim later reported three other firearms stolen on June 9, 2024. Mallory admitted that one of the handguns found in his vehicle and one of the recovered rifles were taken from this victim.
The sentencing announcement was made by Erik S. Siebert, U.S. Attorney for the Eastern District of Virginia; Anthony A. Spotswood, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives Washington Field Division; and Jason S. Miyares, Attorney General of Virginia. The case was prosecuted by Special Assistant U.S. Attorney Eric Gilliland and Assistant U.S. Attorney Stephen W. Miller.
