The United States Attorney’s Office for the Middle District of Pennsylvania has announced the indictment of Roy Ladell Weaver, a 41-year-old resident of Jonestown, PA, and his business, Pro Diesel Werks, LLC. The charges were issued by a federal grand jury for conspiracy to obstruct the Environmental Protection Agency's (EPA) functions and violations of the Clean Air Act.
Acting United States Attorney John C. Gurganus stated that from 2013 to March 12, 2024, Weaver and Pro Diesel Werks allegedly engaged in practices known as "deleting" and "tuning." These practices involved disabling emissions control systems on diesel vehicles and tampering with diagnostic systems to prevent monitoring of these alterations. This activity was reportedly conducted with multiple co-conspirators.
The investigation was led by the EPA’s Criminal Investigations Division. The case is being prosecuted by Assistant U.S. Attorney David C. Williams, Special Assistant United States Attorney Patricia C. Miller, and Environmental Crimes Section Trial Attorney Ronald A. Sarachan.
If convicted under federal law, the maximum penalty for these offenses could include nine years of imprisonment, supervised release after imprisonment, and a fine. Sentencing would be determined by a judge based on federal sentencing statutes and guidelines.
It is important to note that indictments are only allegations at this stage. All individuals charged are presumed innocent until proven guilty in court.
