Settlement reached over ADA violations at Starion Sports Complex

The U.S. Attorney's Office for the District of North Dakota has reached a settlement with Mandan Parks and Recreation concerning the Starion Sports Complex. This resolution follows an investigation into claims that certain elements of the facility violated the Americans with Disabilities Act (ADA) of 1990.

The Starion Sports Complex, which opened in 2017, is an extensive facility featuring ice rinks, a gymnastics center, and various athletic fields. It hosts tenants such as the University of Mary and Mandan School District.

The ADA complaint alleged that the complex was not fully accessible to individuals with disabilities. The investigation revealed several compliance issues, including inadequate accessible paths to seating areas and non-integrated accessible seating in key sections like the competition ice rink. Other areas needing improvement included toilet rooms, concourses, and assistive listening systems.

Under federal law, public entities must ensure accessibility for individuals with disabilities. Newly constructed facilities are required to meet ADA standards for accessibility.

U.S. Attorney Mac Schneider emphasized the importance of accessibility: “Protecting access for individuals with disabilities is a priority for the United States Attorney’s Office.” He acknowledged Mandan Parks and Recreation's cooperation in addressing these issues swiftly.

Assistant United States Attorneys Melissa H. Burkland and Tara Vavrosky Iversen handled this matter alongside Paralegal Specialist Michelle Erdmann.
