Kentucky man indicted for alleged assault during Jan. 6 Capitol breach

A Kentucky resident has been indicted for allegedly assaulting law enforcement officers with a dangerous weapon during the January 6, 2021, breach of the U.S. Capitol. The individual's actions reportedly disrupted a joint session of Congress convened to certify the electoral votes for the 2020 presidential election.

Andrew Kyle Grigsby, 29, from Louisville, Kentucky, faces an indictment unsealed in the District of Columbia on five felony charges. These include civil disorder; assaulting, resisting, or impeding officers using a dangerous weapon and causing bodily injury; entering and remaining in a restricted building or grounds with a dangerous weapon; disorderly conduct in a restricted area using a dangerous weapon; and engaging in physical violence in such areas.

Additionally, Grigsby is charged with two misdemeanors: disorderly conduct within a Capitol building and committing an act of physical violence on Capitol grounds or buildings. He was arraigned on January 10, 2025, and is currently held in Washington D.C.

Court documents state that on January 6, 2021, Grigsby reached the Capitol Grounds and moved through restricted areas to the Northwest stairwell of the Capitol building. At approximately 1:54 p.m., he attempted to breach a police line while holding a black canister believed to contain bear spray. This substance was allegedly used against officers defending the stairwell and building entrance.

The spray reportedly forced officers to retreat temporarily. One officer described experiencing severe pain preventing him from breathing or seeing clearly. Surveillance footage shows Grigsby descending the stairwell at around 1:57 p.m., still carrying the canister.

The U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section are prosecuting this case. The investigation is being conducted by FBI’s Louisville and Washington Field Offices with support from U.S. Capitol Police and Metropolitan Police Department.

Since January 6, 2021, over 1,583 individuals have been charged across nearly all states for crimes related to the Capitol breach. More than 600 face charges for assaulting or impeding law enforcement—a felony offense—and investigations continue.
