Memphis man charged with distributing fentanyl causing death

Andrew Starks, a 44-year-old Memphis resident, has been indicted on charges of distributing fentanyl leading to a victim's death. The indictment was announced by Joseph C. Murphy, Jr., Interim United States Attorney for the Western District of Tennessee.

Chief Cerelyn 'CJ' Davis of the Memphis Police Department stated, "This indictment is the result of intentional and strategic collaboration between the Memphis Police Department and our federal partners. We remain committed to investigating and prosecuting those who distribute fentanyl and other illegal drugs that put lives at risk."

The indictment, returned by a federal grand jury on May 15, 2025, alleges that Starks distributed fentanyl on December 22, 2022, resulting in one fatality. If convicted, Starks faces a minimum federal prison term of 20 years up to life imprisonment. He could also be fined up to $1 million and face supervised release for at least three years post-incarceration. The federal system does not offer parole.

The case investigation was conducted by the Memphis Police Department’s Organized Crime Unit Heroin Opiate Response Team (HORT). Assistant United States Attorney Wendy K. Cornejo is prosecuting the case.

It is important to note that the charges in the indictment are accusations and not evidence. Starks remains presumed innocent until proven guilty beyond a reasonable doubt through due process. Should he be convicted, sentencing will be determined by considering various factors unique to the case such as his criminal record, role in the offense, and specifics of the violation.
