U.S. District Judge Lydia Kay Griggsby has sentenced Erbeth Gomez-Delgado, a 48-year-old resident of Hyattsville, Maryland, to 24 months in federal prison for illegally reentering the United States after deportation. This decision follows a November 2024 conviction by a federal jury that found Gomez-Delgado guilty of Reentry After Deportation.
The sentencing was announced by Erek L. Barron, U.S. Attorney for the District of Maryland, alongside Matthew Davies, Acting Director of Field Operations at the U.S. Customs and Border Patrol's Baltimore Field Office.
Trial evidence revealed that Gomez-Delgado was first encountered by U.S. Customs and Border Patrol on July 29, 2016, as he crossed into the United States through the Rio Grande in Texas without inspection. He was subsequently deported to Guatemala on the same day.
Gomez-Delgado resurfaced in February 2019 when law enforcement discovered his presence in the U.S. following his arrest on charges of sexually abusing a minor in Prince George’s County. During his reentry trial, it was proven that he had unlawfully returned to the country before February 2019 without seeking or receiving permission from either the Attorney General or the Secretary of Homeland Security.
U.S. Attorney Barron expressed gratitude towards U.S. Customs and Border Patrol for their role throughout both investigation and trial phases. Appreciation was also extended to Assistant U.S. Attorney LaShanta Harris and Department of Justice Trial Attorney Shriram Harid for prosecuting this case.
