Maryland Supreme Court plans open meeting on recording rules changes

The Supreme Court of Maryland is set to hold an open meeting on January 6, 2023, via videoconferencing. The session will discuss proposed changes to the Maryland Rules concerning electronic recordings of criminal cases. These proposals come in response to a recent judgment by the United States District Court for the District of Maryland. On December 9, 2022, the court declared Code, Criminal Procedure Article, § 1-201 unconstitutional as it applies to lawfully obtained audio or video recordings of criminal proceedings in Soderberg v. Carrion.

The Standing Committee on Rules of Practice and Procedure has submitted its Two Hundred and Thirteenth Report. This report recommends adopting new Rule 16-504.1 and amending several existing rules on an interim and emergency basis. Interested individuals are encouraged to review these recommendations and submit any written comments by January 4, 2023.
