LITTLE ROCK, Ark. (Legal Newsline) - An Arkansas lawyer says national plaintiffs firm Morgan & Morgan's advertisements in that state unfairly contain testimonials and dramatizations.
Attorney Jody Shackelford filed a lawsuit July 17 against Morgan & Morgan Complex Litigation Services, P.A., alleging that the firm's advertising practices violate both federal and state laws.
The complaint, lodged in the United States District Court for the Eastern District of Arkansas, claims that Morgan & Morgan's use of client testimonials and dramatizations in their advertisements breaches Arkansas Rule of Professional Conduct 7.2, which prohibits such content to prevent misleading and deceptive practices.
Shackelford argues that these advertisements mislead consumers by implying compliance with local professional conduct rules, thereby causing harm to his business by diverting potential clients.
The lawsuit cites violations of Section 5(a) of the Federal Trade Commission Act and FCC regulations against false or misleading advertising. Shackelford seeks compensatory and punitive damages, as well as a preliminary and permanent injunction to stop Morgan & Morgan from continuing these advertising practices.
