Marriott fitness center caused injury, lawsuit says

BOSTON (Legal Newsline) - A man hoping to get in a workout at Massachusetts Marriott says the bench collapsed underneath him, causing injuries.

Marriott International, Inc. and Marriott Claims Services Corporation are facing a lawsuit filed by Douglas Carr, a resident of St. Augustine, Florida. The case was filed in Suffolk County Superior Court on Feb. 22.

Carr alleges that he was injured at the Marriott Courtyard Boston Downtown Hotel on August 15, 2022. He claims that while using the hotel's fitness center, a bench press he was about to use collapsed beneath him, causing him severe injuries.

The plaintiff states that despite his report of the incident to the hotel management and their assurance of an investigation, they refused to provide video footage from the fitness center to aid his medical treatment. 

Carr alleges that this refusal hindered his health care providers from determining if he had struck his head during the fall and assessing the severity of his injuries.

Furthermore, Carr accuses Allison Adams, an adjuster from Marriott Claims Services Corporation, of not making any effort to resolve the matter or offer compensation for his injuries. Adams allegedly denied the existence of any video footage of the incident and abruptly left her position without addressing Carr's claim.

Due to these circumstances, Carr felt compelled to retain counsel and seek legal redress for what he believes was clearly the hotel's fault, the suit says. His lawyer is Russell Pollock of Bergstresser & Pollock.
