America First Legal urges investigation into Kenyon College restroom policy

America First Legal (AFL) has called on the U.S. Department of Education’s Office for Civil Rights and Ohio Attorney General Dave Yost to investigate Kenyon College. The organization claims that the college is in violation of Ohio law and Title IX of the Education Amendments of 1972 by allegedly forcing female students to share restrooms with male students.

On February 12, 2025, Kenyon College President Julie Kornfeld and senior administrators issued a statement addressing the situation. They stated, “[t]he law prohibits Kenyon from knowingly permitting members of the ‘male biological sex’ to use multi-occupancy student restrooms, locker rooms, changing rooms or shower rooms designated for use by members of the ‘female biological sex,’ and vice versa.” Despite this acknowledgment, Kenyon College announced no changes would be made to multi-occupancy restrooms in administrative and academic buildings on campus. The college argues that these facilities “are not considered student restrooms within the meaning of the Ohio law, as they are not, and cannot be, designated for use exclusively by students.”

According to AFL, this policy compels women to share intimate facilities with men across all academic and admissions buildings on campus.

Will Scolinos, Counsel for America First Legal, stated: “Ohio law is clear: multi-occupancy restrooms must be designated for either men or women. Schools of higher education should focus more on educating students rather than re-educating them into radical gender policies that require students, men and women, to share the same restrooms. It is not normal. America First Legal will stand up for the rule of law for all Americans—the fight requires undoing the damage caused by radical administrators at institutions of ‘higher education’ and making common sense common again.”
