MIAMI (Legal Newsline) - Drinkers expect tequila in their hard seltzers if they are labeled as margarita-flavored, a new class action lawsuit says.
In a class action lawsuit filed March 4 in U.S. District Court for the Southern District of Florida, Tamera Fletcher has accused The Coca-Cola Company of misleading consumers about the contents of its Topo Chico products.
The suit blames Coca-Cola for including "alcohol" in its ingredients list, confusing customers who thought a hard seltzer would have tequila.
"Even if purchasers find and read the ingredients, they will be misled because it lists only 'Alcohol,' instead of truthfully disclosing its source as not from tequila, but sugar or another source, like grains, prepared not from distillation but brewing or fermentation..." the suit says.
Underneath the nutrition facts, the product does identify itself as "beer." But that disclosure is not "readily legible to potential consumers under ordinary conditions" because few would turn the box around to look for this information, the suit claims.
