Jell-O's maker sued over preservatives

NEW YORK (Legal Newsline) - A class action lawsuit claims the preservatives in Jell-O are artificial, in contrast with claims made by Kraft Heinz.

Kraft Heinz Foods Company is facing a class action lawsuit, filed Dec. 18 in New York federal court by Enrique Pagan, who alleges that the company's Jell-O gelatin snack products falsely claim to have "No Artificial Preservatives." 

According to the complaint, this representation is misleading as the products contain citric acid, a known artificial preservative commonly used in food products.

The lawsuit further accuses Kraft Heinz of profiting unjustly from its deceptive conduct and violating New York General Business Law §§ 349 and 350, breach of express warranty, and unjust enrichment. The plaintiff asserts that the company's false advertising induced health-conscious consumers to purchase foods they believed were free from artificial preservatives.

Pagan, a New York resident, purchased the product multiple times over the last three years. His most recent purchase was a pack of strawberry flavored Jell-O gelatin snacks in July 2023. He claims he relied on Kraft Heinz's false marketing that the product contained "No Artificial Preservatives."
