Sexual abuse lawsuit filed after accused substitute teacher found dead in jail cell

ST. LOUIS (Legal Newsline) — A 15-year-old in Missouri alleges she was repeatedly raped by one of her teachers while a student in the Mehlville R-9 School District. 

Victim One filed a complaint Sept. 30 in the U.S. District Court for the Eastern District of Missouri against Mehlville R-9 School District, the Estate of Brandon Holbrook and others alleging sexual assault and battery and other claims. 

The plaintiff, a 15 year-old-girl, alleges in her complaint that while a student at Bernard Middle School during the 2021-2022 school year, she suffered physical and sexual abuse, sexual harassment and sexual discrimination by her teacher, Holbrook, who is now deceased. The plaintiff claims that Holbrook sought her out on social media, showed up at her home in August of 2022, and attacked her in her bed and raped her on at least three separate occasions. 

According to the plaintiff's complaint, Holbrook was charged with statutory rape and six counts of statutory sodomy in September of 2022 and was found dead in his jail cell on September 26 at the St. Louis County Justice Center. The plaintiff claims that Holbrook had a history of sexual assaults, domestic violence stalking and other conduct that was reported to law enforcement and that the defendants had knowledge of the reports, yet allowed him to teach in the school district. 

The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Grant Boyd of The O'Brien Law Firm PC in St. Louis.
