SAN FRANCISCO (Legal Newsline) – The Beverly Hills law firm Brodsky & Smith has sued The Mibro Group and Tractor Supply Company under California’s Proposition 65.
Companies that make products that contain chemicals listed on California’s Prop 65 list are required to include warning labels that say they could cause cancer. Some plaintiffs lawyers make millions filing lawsuits.
Plaintiff Gabriel Espinoza and his lawyers filed suit May 23 in San Francisco Superior Court over the chemical Bisphenol A (BPA). They say it is contained in tap and die sets made and sold by Mibro.
Prop 65 allows for civil penalties of up to $2,500 per violation. BPA has been on the Prop 65 list since 2015, and the defendants have been selling the sets at issue since Aug. 16, 2021, the suit says.
“Dermal exposure to BPA is possible when the user handles the products, or the products are placed in contact with exposed areas of the user’s skin,” the suit says. “Finally, exposure through ingestion will occur by touching the products with subsequent touching of the user’s hand to mouth.”
