Fall in shower leads to lawsuit against Disney

ORLANDO, Fla. (Legal Newsline) - A Florida man is alleging a Disney resort failed to provide him with a safe shower in his room.

Jorge Delgado sued Walt Disney Parks and Resorts March 9 in Orange County Circuit Court over his January 2019 stay at Coronado Springs Resort in Lake Buena Vista. He says he requested a non-fixed shower seat in the bathtub to help him while showering.

Three seats didn't fit the bill, the lawsuit alleges, and the fourth was "improper, unsafe and dangerous."

"Upon attempting to stand up and, having pushed himself up from the non-fixed seat with both arms, the seat slipped out from under the plaintiff, causing him to fall and severely and grievously injure himself," the suit says.

Delgado blames Disney for failing to have grab bars on the wall of the shower and for failing to have a nonslip surface on the floor of the bathtub. As a result of his fall, Delgado says he was hospitalized, lost wages and incurred medical expenses.

Delgado is represented by Brian Glatzer of Bernstein and Mayanoff in Miami.
