24 Hour Fitness blamed for man's death after heart attack

SAN FRANCISCO (Legal Newsline) - A California gym faces a lawsuit over the death of one of its customers.

The Estate of Martin Paragras, also known as Celso Paragas, filed a lawsuit Feb. 28 in San Francisco Superior Court against 24 Hour Fitness and its affiliated businesses running a gym in the city. The suit blames 24 Hour Fitness for not having a defibrillator.

Paragas suffered a heart attack on Feb. 20, 2020, at a 24 Hour Fitness on California Street.

"The heart attack should have been survivable, but due to defendants' negligent failure to provide an automatic external defibrillator device and/or program at their gym facility compliant with California Health & Safety Code section 104113, it was not," the suit says.

"Martin Paragas ultimately went into a coma, and his life support was terminated on March 2, 2020."

Wife Everet and son Jake are also plaintiffs in the case, as is Paragas' brother. The plaintiffs are represented by Bryan Vereschagin.
