Wrongful death lawsuit filed over retired trooper's slip-and-fall in bus parking lot

State Court
Dattco

BOSTON (Legal Newsline) - A bus company faces a wrongful death lawsuit after a would-be passenger slipped in its parking lot, hit his head on his car and died.

Patricia Dolan sued Dattco in Massachusetts' Suffolk County Superior Court on Dec. 20 over the death of her husband Charles, who died on Aug. 13, 2020. About nine months earlier, she had driven him to a Dattco location in Fairhaven to board a bus to Boston.

As he exited the car and walked toward his bus, he slipped on ice or snow and fell, the suit says. His head hit his vehicle, resulting in a neck injury, the suit says.

"Said injury ultimately resulted in the death of Charles Dolan," the suit says.

Patricia Dolan says there was inadequate lighting in the parking lot, leaving Charles unable to see the ice or snow. She is represented by Alan Cantor and David Faraci of Swartz & Swartz.

According to his obituary, Charles was a retired Massachusetts state trooper and was married to Patricia for 41 years.
