Family sues McDonald's over trauma from attack after losing personal injury case

NEW YORK (Legal Newsline) - A lawsuit against McDonald's alleges the family of a man who was attacked at a New York location continues to suffer psychological trauma.

Jessica Judd and her children filed suit Dec. 23 in New York County Supreme Court against McDonald's Corporation and McDonald's Restaurants of New York over an incident that occurred three years ago.

The suit says high school-aged kids were insulting and harassing customers at a McDonald's on East 14th Street in New York City in December 2018. The Judds sought help from staff, which only made the situation worse, the suit says.

James Judd was "violently assaulted, attacked, battered and struck without warning... leaving Mr. Judd with facial fractures and eye injuries," the suit says.

Jessica was also assaulted while their children watched, the suit says. A year after the incident, James and Jessica Judd filed a negligent security lawsuit over their injuries.

Justice James Edward D'Auguste granted the McDonald's defendants' motion to dismiss in January 2020, finding they "did not own or operate the franchised restaurant in which the alleged incident took place."

Nevertheless, the Judds have again sued the same defendants, through their attorney Adam Cahn of Sakkas, Cahn & Weiss. The new suit says the children sustained psychological trauma, emotional injuries and pain and suffering.
