Son sues nursing home for wrongful death of father who spent 13 days there

LITTLE ROCK, Ark. (Legal Newsline) -- A son is suing an Arkansas nursing home for the alleged wrongful death of his father. 

Corey Johnston, the special administrator of the estate of James Johnston Jr., deceased, filed a complaint on July 28 in Pulaski County Circuit Court against VVR Healthcare Operations d/b/a The Village at Valley Ranch; VRPC Health Systems LLC; Briar Hill Management, L.L.C.; Joey Wiggins; David Barker in his capacity as Administrator of VVR Healthcare Operations, LLC d/b/a The Village at Valley Ranch; and John Does I-V for wrongful death.

According to the complaint, James Johnston Jr. was a resident of The Village at Valley Ranch from November 1, 2019 until his death on November 14, 2019. 

During the time of his residency, Defendants were on notice and aware of problems with resident care, including those failures and deficiencies that caused injury to James Johnston Jr., at The Village at Valley Ranch, but did nothing to correct those problems, the suit claims. 

Corey Johnston alleges that while his father was a resident, his father sustained medication toxicity, malnutrition, weight loss, falls, septic shock, Stage IV decubitus ulceration to sacrum while on a feeding tube, stage IV decubitus ulceration to left heel and right ankle while on a feeding tube, improper care and ultimately death. Corey Johnston alleges that the staff knew Johnston’s medical history, that substantial malnutrition, dehydration, improper wound care, and stage IV pressure ulcers were especially likely to cause severe injury, sepsis and death.

Johnston seeks general and special damages, cost of litigation, pre-judgement and post-judgement interest, attorney's fees, cost of suit, and punitive damages. Johnston is represented by Kyle Phillip Ludwig.
