Woman sues Walmart for suffering third-degree burns on cart

TEXARKANA, Ark. (Legal Newsline) -- A Texas woman is suing Walmart in Arkansas for allegedly suffering third-degree burns getting on a motorized cart. 

Debra Arterbury filed a complaint in Miller County Circuit Court against Wal-Mart Stores, Inc a.k.a Wal-Mart Stores Arkasas, LLC d/b/a Walmart SuperCenter for personal injury.

According to the complaint, on July 26, 2019, Arterbury went to Walmart to shop. Arterbury has health issues, including a circulatory problem, which required her to use a motorized cart, which is provided by Walmart, the suit says. 

Arterbury found a motorized cart in the parking lot of Walmart and sat in it to enter the store. Her circulatory problem prevented her from knowing the cart was excessively hot, and she suffered third-degree burns to her left leg, she claims. Arterbury alleges that Walmart negligently left the cart in the parking lot allowing it to be in the sun where portions of the cart heated up enough to cause severe burns.

Arterbury seeks compensation for pain and suffering, past and future medical bills, pre-judgment and post-judgment, attorney's fees and cost of suit. Arterbuty is represented by Stewart D. Matthews.
