Texas personal injury lawyers sued by feds to recover part of settlement

HOUSTON (Legal Newsline) - In an attempt to recover a payment made by Medicare, the U.S. government has sued Carrigan & Anderson PLLC of Corpus Christi, Texas, and Stephen P. Carrigan on behalf of the Centers for Medicare and Medicaid Services (CMS).

The government sued in the U.S. District Court for the Southern District of Texas’ Houston Division on March 18.

CMS is a part of the country’s Department of Health and Human Services. The U.S. hopes to seize a payment for Tomas R. Tijerina via the Medicare program.

It sued after Tijerina suffered injuries from a car accident on April 13, 2014. Defendants told CMS’s Medicare Benefits Coordination and Recovery Center (BCRC) that Tijerina reached a $70,000 agreement in a resulting lawsuit. 

BCRC tried to recover the Conditional Payments and issued the defendants an invoice of $46,244.74, that. However, Medicare covered Tijerna’s medical costs, at which point the lawsuit commenced.
