BMW vehicle owners allege N63 engines rapidly consume oil

ATLANTA (Legal Newline) – Seven BMW vehicle owners allege an engine defect causes the vehicles to consume excessive amounts of oil.

Jerry Moore, Yuriy Golonko, Nicole Pass, Sonya Dewberry, Dorothy Jackson, Anthony Osborn and Dwain Jones filed a complaint on Nov. 9 in the U.S. District Court for the Northern District of Georgia against BMW of North America LLC and Bavarian Motor Works alleging breach of warranty pursuant to the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiffs either reside in Georgia or purchased vehicles in Georgia manufactured or sold by the defendants. They allege the N63 engine in their vehicles contains a manufacturing defect that causes the engines to consume oil at a rapid rate. They allege the defendants have failed to remedy the defect and have breached the written and implied warranties.

The plaintiffs request a trial by jury and seek judgment against defendants, refund of the full contract prices, equitable relief, incidental and consequential damages, punitive damages, attorney's fees, and further relief as the court deems just. They are represented by Sergei Lemberg of Lemberg Law LLC in Wilton, Connecticut.
