PORTLAND, Ore. (Legal Newsline) – Law firms from Florida and Ohio allege that an Oregon company overbilled them for reception services.
McKenzie Law Firm PA and Oliver Law Offices Inc. filed a complaint on behalf of themselves and all others similarly situated on Nov. 2 in the U.S. District Court District of Oregon, Portland Division against Ruby Receptionists Inc. alleging breach of contract, unjust enrichment and other counts.
According to the complaint, the defendant operates callruby.com and provides remote telephone reception services. The plaintiffs allege that they engaged defendant to provide them virtual receptionist services.
The plaintiffs allege the defendant overcharges clients by rounding up receptionist time and charging for receptionist time while a caller is in a hold queue when no receptionst is involved with the call.
The plaintiffs hold Ruby Receptionists Inc. responsible because the defendant allegedly wrongfully billed for time that had been rounded up for the defendant's benefit and failed to deliver the contracted-for quantity of receptionist minutes.
The plaintiffs request a trial by jury and seek an award of damages in an amount to be determined at trial, restitution and disgorgement, prejudgment interest, post-judgment interest, declaratory relief, attorneys’ fees, costs, disbursements, and expenses of suit, including expert witness fees. They are represented by Keith S. Dubanevich and Cody Berne of Stoll Stoll Berne Lokting & Shlachter PC in Portland, Oregon and others.
