California management company settles EEOC charges of denying employee medical leave

SAN DIEGO — A California management services company has settled charges by a federal agency of denying an employee medical leave for a disability and then firing her instead of providing a reasonable accommodation.

According to a lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) in the U.S. District Court for the Southern District of California, Triton Management Services did not provide a medical leave for the employee with a disability, violating the Americans with Disabilities Act (ADA). 

"It is important for employers not to let stereotyping dictate how they respond to individuals with physical or mental disabilities in the workplace," EEOC Los Angeles District Office regional attorney Anna Park said in a statement."We commend Triton for resolving this case."

"We are encouraged that Triton is taking steps to put in place policies and practices that will protect and enhance the working conditions for all of their employees," added EEOC San Diego local office director Christopher Green. 

The settlement includes Triton paying $110,000 in relief and revising its written policies to bring them into compliance with the ADA as well as employee training and reporting to a designated equal opportunity officer, according to the EEOC.
