SAN FRANCISCO — A California woman is suing two hair-growth products, alleging fraud, unfair competition and unjust enrichment.
Marianne Padilla filed a class action lawsuit, on behalf of herself and all others similarly situated, July 25 in Alameda County Superior Court against Sundial Brands LLC and Nubian Heritage Inc., alleging violation of California's Sherman Law and False Advertising Law.
According to the complaint, Padilla purchased and tried the defendants' products marketed as hair-growth products under the Shea Moisture and Nubian Heritage brand names. The suit says the products did not cause hair growth as they did not contain minoxidil, the only ingredient certified by the FDA.
The lawsuit states Padilla was caused to spend money on high-price products that were falsely advertised. The plaintiff alleges the defendants marketed products that were false and misleading and profited enormously from unlawful misrepresentations.
Padilla seeks trial by jury, that the court appoint the plaintiff as class counsel, that the defendants conduct corrective advertising, damages, attorney fees, costs of suit and all further relief the court deems just.
