TOPEKA, Kansas (Legal Newsline)--The Kansas Supreme Court has placed a case that Sunflower Electric Power Corp. and partners had pending before them on hold and ordered the utilities to first finish their lower level appeals.
The court ordered the Hays, Kansas-based utility to exhaust its appeals at the district court level and with the state Department of Health and Environment.
The high court's decision Thursday means that the utility might not have a swift decision their application to build two coal-fired power plants in Finney County.
Sunflower Electric Power Corp. sought an air-quality permit from the Department of Health and Environment, but Secretary Rod Bremby in October denied the request for the proposed Holcomb Station expansion.
In addition to asking Bremby to reconsider his decision, Sunflowe also filed a lawsuit in Finney County District Court along with one of its partners.
