Municipal Communications LLC, in its lawsuit filed in a Georgia federal court last week, argues that a condition imposed by Cobb County and its Board of Commissioners, requiring the tower to be moved 300 feet to the east of its original, proposed location, is “unjustified” and doesn’t make sense. The company wants an injunction directing the county to remove the condition.

The company was served with a complaint by both Cobb and Gwinnett counties last month. Comcast now wants the lawsuit removed to federal court. The counties began filing lawsuits against various service providers in December.

The pair of providers argue the lawsuits over unpaid 911 fees don’t belong in state court. One of the providers contends the lawsuit should be dismissed altogether, saying it’s being penalized simply for under-billing customers.

Cobb County filed eight separate lawsuits in federal court last month, alleging the suppliers failed to properly assess, collect and pay 911 charges as required by state law. Gwinnett County joined in filing seven of the suits.
