Two individuals from Honduras have been indicted by a federal grand jury in South Florida for illegal reentry into the United States after removal, violating 8 U.S.C. 1326.
The indictment in case number 25-cr-20192 states that Marvin Wilton Max Ayala has unlawfully entered the U.S. at least five times. He was last encountered in South Florida on April 1 without inspection, admission, or parole by an immigration officer. His previous removals from the country occurred on November 21, 2012, April 6, 2015, May 4, 2020, and August 5, 2021.
In a separate case numbered 25-cr-20186, Brayan Josue Matute-Lobo is charged with entering the U.S. illegally for at least the fourth time. He was found in South Florida on March 8 under similar circumstances as Max Ayala. Matute-Lobo had been removed from the U.S. on February 12, April 21, and December 22 of the year 2016.
Both men are currently held at Federal Detention Center Miami while their cases proceed.
U.S. Attorney Hayden O’Byrne of the Southern District of Florida and acting Field Office Director Juan Agudelo of ICE's Enforcement Removal Operations Prosecutions Unit Miami announced these charges.
The investigations were conducted by ICE-ERO and prosecuted by Special Assistant United States Attorney Melissa Roca Shaw.
