Former Clayton Police Chief pleads guilty in DUI case, enters first offender's program

A former Clayton Police Chief has accepted a plea deal addressing charges stemming from a 2025 drunk driving incident. On April 14, Carl Hutson from Federica pleaded guilty to Driving Under the Influence of Alcohol and entered the First Offender’s Program. As part of this program, Hutson will face a one-year license suspension, a $250 fine, completion of a DUI course, and the use of an Ignition Interlock Device upon resuming driving after one year. The plea concluded an investigation conducted by the Milford Police Department.

“It is simply unacceptable for anyone, but anyone, to get behind the wheel of a car while under the influence of alcohol,” stated Attorney General Kathy Jennings. She further remarked, “Drunk driving incidents, including by those who should frankly know better, are frighteningly commonplace and can have devastating, lifelong, or even fatal consequences. We are extremely lucky that no one was injured in this case and hope that treatment and accountability keep the defendant a one-time offender.”

On January 3, 2025, Hutson, aged 49, was caught driving under the influence and going the wrong way on North Church Street in Milford, Delaware. He failed field sobriety tests and recorded a 0.17 blood alcohol concentration (BAC) on a breathalyzer test. There were no collisions reported from the incident.
