The United States Attorney’s Office for the Middle District of Pennsylvania has announced the indictment of Porfirio Peralta-Nunez, a 46-year-old resident of York, Pennsylvania, for illegal reentry into the United States. The charge was issued by a federal grand jury.
According to Acting United States Attorney John C. Gurganus, the indictment claims that Peralta-Nunez was previously removed from the United States on August 20, 2019, via Alexandria, Louisiana. He was allegedly found again in the United States without legal permission to return. The indictment further states that on October 24, 2023, Peralta-Nunez was encountered in York County, Pennsylvania, after his removal in relation to a court order, following a drug trafficking conviction in New Jersey.
U.S. Immigration and Customs Enforcement and Removal Operations investigated the case, while Assistant U.S. Attorney Francis P. Sempa is handling the prosecution.
This case falls under "Operation Take Back America," a nationwide initiative by the Department of Justice. The operation aims to curb illegal immigration, dismantle cartels and transnational criminal organizations, and protect communities from violent crime. It integrates resources from the Department’s Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood.
The offense carries a maximum federal penalty of 20 years in prison, a term of supervised release, and a fine. Sentences are imposed by a judge after accounting for federal sentencing statutes and guidelines.
