Sex offender pleads guilty to not registering in Oklahoma

Nicholas Hammer has pleaded guilty to failing to register as a sex offender, a charge that could result in up to ten years of imprisonment. Hammer, 46, a former resident of Tahlequah, Oklahoma, entered the guilty plea in the United States District Court for the Eastern District of Oklahoma.

This legal matter stems from an indictment that accused Hammer, previously convicted of First Degree Rape in January 2001, of not fulfilling his obligation to register as a sex offender. Notably, the indictment states that Hammer failed to update his registration between October 10, 2024, and November 4, 2024, during which he entered, exited, or lived in Indian country within the Eastern District of Oklahoma.

The case was investigated by the United States Marshals Service alongside the Cherokee Nation Marshal Service. U.S. Magistrate Judge D. Edward Snow accepted the guilty plea and mandated a presentence investigation report. Until sentencing, Hammer remains in the custody of the United States Marshals Service.

Hammer's sentencing will be presided over by a U.S. District Court Judge, who will consider the U.S. Sentencing Guidelines and other relevant statutory factors when determining the penalty. The prosecution of the case is being handled by Assistant U.S. Attorney Emily Wittlinger.
