Terrance Payne Hayes, a 40-year-old resident of Sioux City, has been sentenced to over seven years in federal prison. This follows his guilty plea on October 16, 2024, for illegal possession of a firearm as a felon, drug user, and person convicted of domestic violence.
The investigation into Hayes began after a July 2023 home invasion and homicide. During the incident, an individual entered Hayes' residence armed with knives to retrieve a stolen firearm that Hayes possessed. The confrontation resulted in Hayes being stabbed multiple times before he fatally shot the intruder with the stolen weapon.
Hayes has a significant history of violent behavior. The sentencing court described his record as "stunning," noting repeated convictions for domestic abuse assault and other crimes involving threatening conduct. Incidents include confronting his former girlfriend's father by breaking their gate, throwing bricks through windows, and threatening individuals with firearms. He also engaged in stalking and intimidation behaviors.
Judge Leonard T. Strand sentenced Hayes to 90 months in prison followed by three years of supervised release. There is no parole in the federal system.
United States Attorney Timothy Duax remarked on the case: “Individuals like Mr. Hayes who repeatedly assault and threaten the citizens of our district will be caught, prosecuted, and punished." He commended local law enforcement agencies for their efforts leading to this conviction.
This case was part of Project Safe Neighborhoods (PSN), an initiative by the Department of Justice aimed at reducing violent crime through community collaboration and focused enforcement strategies.
Hayes remains in custody under the United States Marshal's supervision until his transfer to federal prison is arranged.
The investigation was conducted by the Sioux City Police Department, Woodbury County Attorney’s Office, and Bureau of Alcohol, Tobacco, Firearms, and Explosives. Assistant United States Attorney Forde Fairchild prosecuted the case.
