Officer-involved death in Fond du Lac under investigation

The Wisconsin Department of Justice Division of Criminal Investigation (DCI) is currently examining an officer-involved death that took place in the Town of Fond du Lac, Wisconsin. The incident occurred on the evening of February 24, 2025.

According to reports, Jesus Armando Mendez Berry, a 26-year-old man with a felony warrant for his arrest, contacted the Fond du Lac County Sheriff’s Office intending to surrender. Additionally, a citizen reported seeing someone matching Mendez Berry's description carrying what appeared to be a handgun in his waistband. Deputies found Mendez Berry on Cherrywood Drive shortly thereafter.

Despite repeated commands from deputies to show both hands, Mendez Berry did not comply. A deputy discharged a non-lethal weapon before Mendez Berry displayed what was believed to be a firearm. Upon investigation by DCI at the scene, the item was identified as a black Gamo 430 CO2 Pellet/BB Handgun. In response to this perceived threat, Sergeant Andrew Kohlmann of the Fond du Lac County Sheriff’s Office fired his weapon at 6:22 p.m., hitting Mendez Berry.

Emergency medical services were called and attempted life-saving measures; however, Mendez Berry was pronounced dead after being transported to a nearby hospital.

No injuries were reported among law enforcement or other members of the public during this incident. Sergeant Kohlmann remains on administrative assignment according to agency policy.

Sergeant Kohlmann wore a body camera during the incident, and its footage is under review. The DCI leads this investigation with assistance from various local law enforcement agencies including Wisconsin State Patrol and Fond du Lac Police Department. All involved officers are cooperating fully with DCI's ongoing investigation.

Once complete, investigative reports will be submitted to the Fond du Lac County District Attorney’s office for further action.
