A Guatemalan national living in Waltham has been indicted by a federal grand jury for illegally reentering the United States after being deported. William Estruado Rodriguez-Botello, aged 39, faces one count of unlawful reentry of a deported alien.
The charge carries a potential sentence of up to 20 years in prison, followed by three years of supervised release and a fine that could reach $250,000. Upon completing any sentence imposed, Rodriguez-Botello is subject to deportation. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and statutes relevant to criminal cases.
United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston, announced the indictment. The case is being prosecuted by Assistant U.S. Attorney Luke A. Goldworm from the Major Crimes Unit.
It is important to note that the details within the charging documents are allegations at this stage. The defendant remains presumed innocent unless proven guilty beyond a reasonable doubt in court.
