Guatemalan national pleads guilty to illegal re-entry and failing to register

A Guatemalan national has admitted guilt in a U.S. District Court in Providence to charges of failing to register as a sex offender and re-entering the United States after deportation. This announcement was made by Acting United States Attorney Sara Miron Bloom.

Nelson Leonel Yocute Samayoa, aged 34, had been previously convicted in 2014 in Rhode Island state court for second-degree sexual assault. Following this conviction, he was required to register as a sex offender and was subsequently deported.

Court records indicate that after his deportation, Yocute illegally returned to the United States and resided and worked in Newport for about nine years. During this time, he did not fulfill his obligation to register as a sex offender, which was part of his sentence from 2014.

Yocute has been held since his arrest on May 14, 2024. His sentencing is set for June 12, 2025. A federal district judge will determine the sentence based on the U.S. Sentencing Guidelines and other legal factors. Yocute will also undergo deportation proceedings again.

Assistant United States Attorney Denise M. Barton is prosecuting the case.

The investigation was conducted by the Newport Police Department with support from Homeland Security Investigations and the United States Marshals Service.
