A transportation company in Fairview, Oregon, and its owner were sentenced in federal court for tampering with emissions monitoring devices. Clancy Logistics, Inc., and Timothy Curtis Clancy, 55, from Sherwood, Oregon, received three years of probation and a joint fine of $101,510.
Court documents revealed that between October 2019 and July 2023, Clancy engaged in "deletes and tunes" on emission control systems for at least thirteen diesel semi-trailer trucks. As the owner of Clancy Logistics, he directed employees to remove emissions control equipment and modify onboard diagnostic systems to prevent detection.
On September 13, 2024, both Clancy Logistics and Clancy faced charges for violating the Clean Air Act. They pleaded guilty to one count of tampering with a monitoring device on September 18, 2024.
The Environmental Protection Agency's Criminal Investigation Division led the investigation. Andrew Ho from the District of Oregon and Gwendolyn Russell from the EPA prosecuted the case.
