Chazy man indicted for alleged involvement in alien smuggling operation

Bailey Burger, a 38-year-old resident of Chazy, New York, has been indicted on charges related to alien smuggling. The announcement was made by United States Attorney Carla B. Freedman and Chief Patrol Agent Robert N. Garcia of the United States Border Patrol, Swanton Sector.

Burger faces one count of conspiracy to commit alien smuggling for profit and four additional counts of alien smuggling for profit. These charges are linked to an incident on January 26, 2025, where he allegedly smuggled four Indian citizens into the United States. It is important to note that these charges are accusations, and Burger is presumed innocent until proven guilty.

If convicted on all counts, Burger could face a prison sentence ranging from five to fifteen years, along with at least three years of supervised release following imprisonment. Sentencing will be determined by a judge based on relevant statutes and guidelines.

Burger was arraigned in Plattsburgh before United States Magistrate Judge Gary L. Favro and remains detained pending a hearing scheduled for February 20.

The U.S. Border Patrol is leading the investigation into this case. Special Assistant United States Attorney Parvinder Nijjar and Assistant United States Attorney Jeffrey Stitt are responsible for prosecuting the case.
