A federal grand jury in Pittsburgh has indicted a Honduran citizen for illegal re-entry into the United States. The announcement was made by Acting United States Attorney Troy Rivetti.

The indictment charges Luis Fernando Diaz-Garcia, aged 27, as the sole defendant in this case. According to the indictment, Diaz-Garcia was found in western Pennsylvania in August 2024 after having been removed from the U.S. on November 13, 2019. Public records indicate that he was charged by criminal complaint in Allegheny County by the Pennsylvania State Police for alleged conduct occurring on or about August 19, 2024.

The law stipulates a maximum sentence of up to two years imprisonment and a fine of up to $250,000, or both. The actual sentence would be determined based on the seriousness of the offense and Diaz-Garcia's prior criminal history.

Assistant United States Attorney Rebecca L. Silinski is prosecuting the case for the government. The investigation leading to this indictment was conducted by U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations.

It is important to note that an indictment is merely an accusation and a defendant is presumed innocent until proven guilty.
