Arizona AG settles disability act violation case with healthcare provider

Attorney General Kris Mayes has announced a settlement involving Acadia Healthcare Company, Inc. and its subsidiary Sierra Tucson, L.L.C., following allegations of violations under the Arizonans with Disabilities Act (AzDA). The lawsuit claimed that Sierra Tucson failed to provide effective communication to a hard-of-hearing individual during her inpatient treatment.

The AzDA mandates that public accommodations must not discriminate against individuals with disabilities in their services. Attorney General Mayes emphasized the importance of equal communication access for Arizona's over 500,000 Deaf and hard-of-hearing residents. "A person who is seeking inpatient behavioral health services is particularly vulnerable," she stated. "When necessary for a person’s disability, Arizona businesses must make modifications to their services to ensure all Arizonans are treated equally regardless of hearing ability."

The case originated from a 2021 complaint by a former patient at Sierra Tucson who alleged inadequate communication support during her month-long treatment. As part of the Consent Decree, Sierra Tucson will pay $149,522.75 to the former patient and cover her attorney fees. Additionally, they will pay a $5,000 civil penalty to the State of Arizona.

Sierra Tucson has also agreed to revise its policies to ensure effective communication for patients with disabilities and train staff on providing necessary aids and services. The facility will undergo three years of monitoring by the Civil Rights Division to ensure compliance.

Assistant Attorneys General Chris Carlsen, Ryan Bishop, Natalie Trouard handled the litigation, with Civil Rights Division Compliance Officer Alisha Kram conducting the investigation.

The Civil Rights Division aims to enforce civil rights laws and increase public awareness across Arizona. Individuals who believe they have faced discrimination can contact the division or submit an intake questionnaire online.
